Former employees accuse Perfection Pet Food of labor code violations March 9, 2022 – 07:38 am

SACRAMENTO – A Visalia dry pet food manufacturer is accused of not paying for missed meal and rest periods and other violations.

Steven Villarreal, Agustin Benitez and Carlos Morales filed a complaint on behalf of themselves and all others similarly situated on Nov. 2 in the U.S. District Court for the Eastern District of California against Perfection Pet Foods LLC alleging violations of California labor codes.

According to the complaint, the defendant requires employees to work 12-hour shifts but fails to provide those employees with proper meal and rest periods. The plaintiffs also allege they were not provided full wages, accurate paystubs and rights to the Family and Medical Leave Act, thereby causing them to suffer lost wages, benefits and interest.

The plaintiffs hold Perfection Pet Foods LLC responsible because the defendant allegedly failed to provide employees with proper meals and rest periods, retaliated against employees who filed for medical leave by terminating employment, and failed to provide accurate wage statements.

The plaintiffs request a trial by jury and seek judgment against defendant, certify this suit as a class action, designate class representative and counsel, damages and restitution, attorney's fees, costs, interest and other relief as the court deems just. They are represented by Richard A. Hoyer, Ryan L. Hicks and Jennifer E. McGuire of Hoyer & Hicks in San Francisco and Walter Haines of United Employees Law Group PC in Huntington Beach.
